Powell v. Portland Public School District (Multnomah County, Portland Oregon No. 01043557)

   Nancy Powell filed a new lawsuit on April 5, 2002, in Multnomah Co. Circuit Court seeking to prohibit the BSA from recruiting students during the school day in Portland Public Schools on the grounds that the Scouts discriminate on the basis of religion. Oregon ACLU Executive Director David Fidanque said "An organization that excludes students based on their religious beliefs should not be given special access to elementary schools during the school day in order to carry out their discriminatory policies." "Oregon law prohibits religious discrimination by school districts. By providing a platform for the Boy Scouts when students are required to be in school, Portland Public Schools are actively assisting and supporting that discrimination by the Boy Scouts," Fidanque said.
